Warranty Terms & Conditions:

Australian Portable Toilets Pty Ltd (ABN 71 095 982 746) (“APT”) warrants that its products are free from defects in materials and workmanship for the warranty periods set out below.

If a product is found to be defective during the applicable warranty period, APT may, at its discretion:

  • Repair the product;
  • Supply replacement parts;
  • Replace the product; or
  • Refund the purchase price where required by law.

The warranty period commences from the date of purchase shown on the original APT tax invoice.

    What Is Covered

    This warranty covers defects arising from faulty materials or workmanship during normal use of the product.

    What Is Not Covered

    This warranty does not cover:

    • Normal wear and tear;
    • Cosmetic damage, fading or discolouration;
    • Misuse, abuse or neglect;
    • Improper installation, operation or maintenance;
    • Accidental damage;
    • Fire, flood, storm, lightning or other extreme weather events;
    • Transport damage occurring after delivery;
    • Damage caused by chemicals or substances not recommended for use with the product;
    • Unauthorised modifications, alterations or repairs;
    • Use of the product outside its intended purpose; or
    • Any cause other than a defect in materials or workmanship.

    Making a Warranty Claim

    To make a warranty claim, please contact APT within 30 days of becoming aware of the alleged defect.

    You may be required to provide:

    • Proof of purchase;
    • Details of the defect;
    • Photographs of the product and defect;
    • Product serial numbers where applicable; and
    • Any additional information reasonably required by APT to assess the claim.

    Warranty Assessment & Returns

    APT reserves the right to inspect and assess all warranty claims before approving any repair, replacement or refund.
    As a condition of any warranty claim, APT may require the product, or the defective component, to be returned to an APT nominated service location for inspection, testing, repair or replacement.
    On-site warranty service is not included in the purchase price of the product and will only be provided at APT’s sole discretion and where agreed by APT in writing.

    Unless otherwise required by law:

    • The customer is responsible for all freight, transport, packaging and insurance costs associated with returning products for warranty assessment;
    • The customer is responsible for delivering the product to an APT nominated service location when requested;
    • APT is not responsible for labour costs associated with diagnosing, removing, reinstalling or replacing products;
    • APT is not responsible for travel, accommodation, equipment hire, site attendance, downtime, loss of income, loss of profits or any consequential costs associated with a warranty claim.

    Where replacement parts are supplied, APT may require the return of the defective part before a replacement part is dispatched.

    Failure to return a requested product or component may result in the warranty claim being declined.
    Any product or component replaced under warranty becomes the property of APT.
    Repairs or replacements provided under warranty do not extend or restart the original warranty period.

    Australian Consumer Law

    This warranty is provided in addition to any rights and remedies available under the Australian Consumer Law.
    Nothing in these Warranty Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot be excluded by law.

    General

    If any provision of these Warranty Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
    These Warranty Terms & Conditions are governed by the laws of Victoria, Australia.

    SHIPPING & RETURNS POLICY

    1. SHIPPING

    Small items are shipped Australia-wide.

    Orders are dispatched within 1–3 Business Days.

    Delivery timeframes are estimates only.

    2. COSTS

    Shipping costs are calculated at checkout.

    3. DELIVERY

    Customers must ensure delivery details are correct.

    Additional fees may apply for failed deliveries.

    4. RISK

    Risk passes upon dispatch.

    5. RETURNS

    Goods are covered by Australian Consumer Law.

    6. CHANGE OF MIND

    Returns are assessed case-by-case.

    Items must be unused and in original condition.

    FULL TERMS OF SALE

    1. APPLICATION

    These Terms apply to all Goods supplied by Australian Portable Toilets Pty Ltd (APT) and prevail over any other terms unless agreed in writing.

    2. ORDERS

    All orders are subject to acceptance by APT. APT may accept or reject any order at its discretion.

    3. PRICING

    Prices are as invoiced and exclude GST unless stated. APT may vary pricing prior to delivery if costs change or orders are varied.

    4. PAYMENT

    Approved customers must pay within 30 days from end of month. APT may require deposits and may suspend supply if accounts are overdue.

    5. DEFAULT

    If payment is overdue, interest may be charged at 12% per annum. APT may recover all costs, suspend supply, and demand immediate payment of all outstanding amounts.

    6. DELIVERY

    Delivery times are estimates only. APT is not liable for delays or failure to deliver. Delivery costs are borne by the Customer unless agreed otherwise.

    7. RISK

    Risk in the Goods passes to the Customer upon dispatch.

    8. TITLE

    Title in the Goods remains with APT until full payment is received. APT may recover Goods if payment is not made.

    9. RETURNS

    Returns require approval. Claims must be made within a reasonable time. Goods must be unused and in original condition unless faulty.

    10. PPSA

    The Customer grants APT a security interest in all Goods supplied and their proceeds. APT may register its interest under the PPSA.

    11. WARRANTY

    Goods come with guarantees under Australian Consumer Law. APT will repair, replace or refund defective goods as required by law.

    12. LIABILITY

    APT is not liable for indirect or consequential loss. Liability is limited to the value of the Goods supplied.

    13. INDEMNITY

    The Customer indemnifies APT against all losses arising from misuse of Goods or breach of these Terms.

    14. TERMINATION

    APT may terminate supply or credit arrangements if the Customer breaches these Terms.

    15. FORCE MAJEURE

    APT is not liable for delays caused by events beyond its control.

    16. INTELLECTUAL PROPERTY

    All designs, tooling and intellectual property remain the property of APT.

    17. GOVERNING LAW

    These Terms are governed by the laws of Victoria, Australia.
